1. Agreement and business authority
These Terms of Service apply to businessbotbuddy.app, any official Business Bot Buddy mobile application when released, and automation or support services supplied by Business Bot Buddy. By purchasing, accessing or using a service, you agree to these terms, the applicable written scope or proposal, and any checkout terms shown by Whop.
You must be at least 18 and authorised to act for the relevant business. If you use the service for an organisation, “you” includes that organisation.
2. Scope, commencement and delivery
Scoped before work begins. We confirm your requirements, deliverables, timing and ongoing costs first. Once you approve the scope and complete the required payment, we begin building and configuring your system. If you do not approve the scope, custom development does not begin.
Services are limited to the purchased package, written scope, approved integrations and stated support level. Delivery timing depends on receiving required information, access, content and approvals from you. Additional requests may require a separate written quote and approval.
3. Accounts and organisation access
When independent accounts become available, you must provide accurate registration information, protect login credentials and promptly report suspected unauthorised access. Access is personal to the authorised user and relevant organisation. You must not attempt to access another organisation’s data, bypass security controls or share access with an unauthorised person. The public client portal will remain unavailable until independent authentication and organisation separation have been tested.
4. Customer responsibilities
- Provide accurate information, lawful instructions and required platform access.
- Obtain all authority, notices and consents needed to process customer, staff or third-party information.
- Review and approve customer-facing wording, AI output and automation behaviour before and during use.
- Keep source systems, passwords, devices and third-party accounts reasonably secure.
- Use email, SMS and other electronic marketing only with valid consent, sender identification and a functional unsubscribe method.
- Maintain human oversight for sensitive, high-impact or unusual situations.
5. AI limitations and acceptable use
AI output may be incomplete, inaccurate or unsuitable. Business Bot Buddy assists selected business workflows and does not replace professional legal, financial, medical, safety, employment or regulatory advice. You remain responsible for decisions, communications and actions taken using the service.
You must not use the service for unlawful, deceptive, harmful, discriminatory, rights-infringing, privacy-invasive, malicious or unsolicited-spam activity; to impersonate another person; to distribute malware; or to interfere with the service or another customer. The public interactive preview is a simulation and must not be represented as performing live automation.
6. Setup fees, subscriptions and billing
Prices are in Australian dollars unless clearly stated otherwise. Setup fees cover the agreed discovery, mapping, configuration, implementation and testing work. Recurring fees cover the services and support described in the package or written scope, commencing on the date disclosed at checkout or in that scope.
Payments and recurring subscriptions are processed through Whop. Third-party usage or licence charges outside the agreed scope are payable only where disclosed and approved. Failure to pay may result in paused work, support, automations or account access after reasonable notice.
Cancellation and refund requests are governed by the Refund & Cancellation Policy, the purchased terms and rights that cannot lawfully be excluded. Deleting an app account does not by itself cancel a Whop subscription.
7. Third-party services and integrations
Some services rely on third-party hosting, payments, software, communications or customer-selected platforms. Whop handles checkout and subscription management, and the website uses OpenAI Sites infrastructure. A third-party provider may change, suspend or discontinue its service. We will not promise or enable an integration until compatibility, access, cost and responsibility have been confirmed in the scope. Your use of third-party services may also be subject to their terms and privacy policies.
8. Intellectual property and customer content
You retain ownership of content, branding and business materials you supply. You give us permission to use that material only as reasonably necessary to scope, configure, test and provide the agreed service.
We retain ownership of our pre-existing software, systems, methods, templates, prompts, processes and know-how. Once agreed fees are paid, you receive a non-exclusive, non-transferable licence to use the configured deliverables for your own business, subject to the written scope and third-party licence terms.
9. Confidentiality and information
Each party must take reasonable steps to protect confidential business information received from the other and use it only for the agreed service, except where disclosure is authorised, already public through no breach, independently developed, or required by law. Personal information is handled as described in the Privacy Policy.
10. Availability and changes
We aim to provide reliable services but do not guarantee uninterrupted availability, error-free AI output, compatibility with every platform or any particular revenue, saving, lead or business result. Planned maintenance, emergencies, internet failures and third-party outages may affect availability. We may make reasonable changes needed for security, compliance or service operation and will provide notice where a change materially affects an active paid service.
11. Consumer rights and liability
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, including applicable rights under the Australian Consumer Law.
Subject to those non-excludable rights and to the maximum extent permitted by law, neither party is responsible for indirect or consequential loss that was not reasonably foreseeable. Any permitted limitation will be applied only to the extent it is fair, reasonable and lawful in the circumstances.
12. Suspension, termination and account deletion
Either party may end an ongoing service according to the purchased plan or written scope. We may suspend or end access where reasonably necessary because of material breach, unlawful use, a security risk or non-payment, and will provide notice and an opportunity to remedy the issue where appropriate.
Account deletion can be requested through the Account Deletion page. Ending an account does not remove payment obligations already incurred or automatically cancel an external Whop subscription.
13. Complaints, disputes and governing law
Please contact us first with details of a complaint and the outcome sought. Before starting formal proceedings, both parties should try in good faith to resolve the dispute by written notice and reasonable discussion. These terms are governed by the laws applicable in Queensland, Australia, subject to any mandatory law or jurisdiction that applies.
14. Changes, contact and legal review
We may update these terms when the website, app, services, providers or legal requirements change. Updated terms will be published with a revised effective date. Material changes affecting an active paid service will be communicated where reasonably practicable.
